What is Dispute Resolution Services?
The Dispute Resolution Service is used when there is a need to resolve a specific dispute between two parties, this is generally a consumer and a supplier, business or tradesperson and when those parties are not able to amicably agree on the dispute. The DRS is used with the sole intention of resolving a dispute to avoid the need to go to court.
At Hydrogard we use both mediation and arbitration skills to help, whether there is a family dispute or a business dispute, the aim of the DRS service is to find an amicable solution to the problem, this is normally achieved by agreeing to a compromise agreement, which satisfies both parties.
Why use dispute resolution?
Here at Hydrogard Legal Services, we understand that if a complaint is not dealt with and it escalates it can cause unnecessary pain and suffering to one or both parties. Sometimes disputes escalate and then lead to long and costly court proceedings, which can be a drain on both parties and the families involved can be split by the pressure and the feeling that a side should be taken.
What if my dispute is with a tradesperson or business?
From a consumer perspective, DRS is a much more effective way to handle complaints, it is considerably cheaper option to the consumer, rather than spend your time and money taking a business to court, which could result in them closing their business and reopening the next day with a new name, DRS can find appropriate and amicable solutions.
From a business perspective, agreeing to use a professional dispute resolution service has several benefits, it can stop impulsive social media posts, it can stop the information being put in to the public domain and it is confidential between the parties. Using DRS takes the emotion out of the situation as disputes are resolved impartially and based on facts. Will using dispute resolution services cost me more money?
If you are a member of our CPS programme then no and on the contrary, the idea behind using our DRS process is to save you both time and money.
As part of our Consumer Protection Service you will have access to unlimited telephone conversations with a member of our professional team who will listen and understand the dispute before starting the process.
You will be able to speak to an experienced member of the team in depth and put your side of the dispute to us and we will listen to both yours and the other sides version of the dispute and then make an informed and balanced recommendation to resolve the dispute, but this is all part of the Consumer Protection Service.
What if a dispute cannot be reconciled?
If every avenue and option is investigated and the dispute resolution is still not being agreed by both parties, then we will offer both sides the option of reverting to either an arbitration or mediation process.
There is a charge for both arbitration and mediation processes as there are normally meetings or telephone interviews that have to take place and in both circumstances a report is written. Arbitration can be dealt with over a two to three day process depending on the complexity of the dispute, whereas mediation can be an on-going process, as an example like a family separating.
You should consider arbitration services when two parties involved in a dispute cannot agree a satisfactory resolution between themselves, then it would be a good idea to use arbitration.
When you use arbitration the parties give the power to decide the dispute to the arbitrator. Both evidence and argument are considered and a written arbitration agreement is issued. The process can be as formal or informal as the parties’ desire.
